Help! Can my mother really steal my home from me?

Like fools, my husband and I were convinced by my mother who was recently divorced and had no where to go that we should sale our small home and buy a new big home that would accomodate her moving in with us. We didn’t really want to as, the house we had was small, but very affordable, but she’s my mom and I felt bad for her.So She gave us k and we bought a bigger home. Now, 6 months later it is not working out to say the least, our one condition of her living with us was that her ex-husband who is a drug addict & a criminal was never allowed to be in my home. She told me he moved to the east coast & he was gone.I was suspicious cuz things in my home appered to be tampered with.I installed surveillance cameras & caught him in my home.Now I am having her evicted but she is syaing she owns 1/3 of this house.I am giving her K back no problem, but she really thinks she owns a 1/3.Her name is on nothing and we have no contracts or writen agreements.Does she have a case?

    O honey, your mom is just talking a large game, because she is scared that you’re kicking her to the curb. Don’t worry about it, especially if you are giving her the 20K back. She has nothing by law, that could have her sue you for 1/3 of the house. Just tell her calmly. I am giving you back the money you gave us, we appreciated it but sorry to say that this situation is no longer an option. You do not have any type of ownership with this house, because you do not have your name on any legal document. Not to mention that you have lied to us, which is very hurtful.- then be done with it. One thing though, I’d change the locks to my house, you don’t want her bitter and scorned and getting her criminal lover coming to your house, to pay you an unwelcome visit.

    If her name isn’t on anything, I would say she doesn’t have a case.

    Did she put the $20,000 into your account, for you to pay towards the house? If so, I think it would be considered legally a gift.

    nope, as long as her name does not appear on anything, she has no grounds what so ever.

    If you can give her the money back and document it, her case is very, very thin and she knows it. She’s bluffing. Call her bluff. Your mom is using her and sometimes parents need yanked HARD to know who is in charge now. Get to yanking. You have all the control now, and if you ever have kids you can always deny her access. Start yanking her chain hard now and she’ll come around and start doing things your way.

    Is she really your mom? Not step-mom? I never thought mothers could be like this… anyway.. practically speaking.. if your mom insist just return back all the things that she bought for the house and that sums up the 1/3!!

    no she has nothing becasue her name is on nothing and if the money was a gift you don’t HAVE to give that back either.

    if the home is in your name and your husbands NO she has no case ,so kick her out and you wont have to deal with her lies or her Junkie b/f keep the tape handy and use it in court if she wants to go that far ! pay her the money back asap !!

    You got the house weather she goes to court. If she takes it to court with no written agreement or contracts (that’s like the most important proof!) they aren’t going to believe her story or even take the time to listen since what she says isn’t true without a document of some kind.And you can prove your story cause you have the papers,the money to pay her back, and the video of that guy.     She could get a lawyer and try to get more. But, has the house gone up in value since you bought it? If so, find out how much and divided it by 3 and pay her off. She has not been honest with you. You have to protect yourself even though she is your mom. My daddy always told me that you come in this world alone and go out alone. Iam sure this is not helping your relationship with your husband. Go to a lawyer and take care of this before you owe her more and let her go to her worthless man. She made her choice, let her live with it. If their is any children involved, get rid of her. Children are not be be exposed to this creep she is with.

    I don’t think she has a case. Just get on the phone to an attorney in front of her – she’ll certainly change her song. :)
